Terms of Service
Last updated: 13 September 2026
These Terms of Service ("Terms") are a legal agreement between KRIMSOLS ("ToffeeOS," "we," "us," or "our") and the restaurant, cafe, or other food-service business ("you," "Client," or "Tenant") that registers for or uses the ToffeeOS software platform ("Service"). By creating an account, signing up, or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1. What ToffeeOS Is
ToffeeOS is a point-of-sale, kitchen management, staff, and reporting platform for restaurants and cafes, provided as a hosted, multi-tenant software service. Features may include (depending on your plan): point-of-sale order taking, kitchen display, table and delivery management, staff/HR and payroll tracking, inventory, reporting, online/QR ordering for your customers, and optional WhatsApp messaging.
We may add, change, or remove features at any time. We'll make reasonable efforts to notify you of material changes that affect your use of the Service.
2. Accounts and Access
- You are responsible for maintaining the confidentiality of login credentials, staff PINs, and any access codes issued to your staff, and for all activity that occurs under your account.
- You must provide accurate business information during signup and keep it up to date.
- You are responsible for controlling which of your staff members have access to the Service and at what permission level. ToffeeOS is not responsible for actions taken by individuals you have granted access to.
- We may suspend or terminate accounts that are used fraudulently, abusively, or in violation of these Terms.
3. Your Data and Responsibilities
- Your business data (menu, prices, orders, sales, inventory, staff records, payroll figures, and your customers' contact details) belongs to you. We process and store it in order to provide the Service.
- You are solely responsible for the accuracy of the data you enter (prices, taxes, wages, etc.) and for complying with applicable laws in how you run your business — including tax reporting, labor law, minimum wage, and food-safety regulations. ToffeeOS is a software tool; it does not provide legal, tax, accounting, or HR advice, and figures it calculates (e.g. payroll, tax) are only as accurate as the settings and data you provide.
- If you collect personal data from your own customers through the Service (e.g. phone numbers for online ordering or WhatsApp notifications), you are responsible for having a lawful basis to do so and for your own obligations to those customers. Our Privacy Policy describes how we, as your service provider, handle that data on your behalf.
- You must not use the Service to store or transmit unlawful content, or data you do not have the right to collect.
4. Subscription, Fees, and Billing
- Access to paid features is governed by the subscription tier you select. Fees, billing cycle, and payment method will be communicated to you at signup or renewal.
- Billing is currently handled manually (invoice/bank transfer or as otherwise agreed) rather than through automatic card billing. Payment terms will be confirmed with you directly.
- Fees are non-refundable except where required by law or expressly agreed in writing.
- We may change pricing for future billing periods with reasonable advance notice.
- Failure to pay may result in suspension or downgrade of your account after notice.
5. Acceptable Use
You agree not to:
- Use the Service to send unsolicited bulk messages (including via WhatsApp) to people who have not consented to receive them;
- Attempt to breach, probe, or circumvent the security of the Service, including other tenants' data;
- Reverse-engineer, resell, sublicense, or white-label the Service without our written permission;
- Use the Service for any unlawful purpose.
6. Service Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance, due to third-party provider outages (hosting, database, messaging providers), or for reasons outside our reasonable control. Where the Service supports offline operation for point-of-sale functions, this is a best-effort resilience feature, not a guarantee against data loss during extended outages.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be error-free or meet all of your specific business requirements.
8. Limitation of Liability
To the maximum extent permitted by law, ToffeeOS and its owners/operators will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, lost revenue, or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the fees you paid us in the three (3) months preceding the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Termination
- You may stop using the Service and close your account at any time by contacting us.
- We may suspend or terminate your access if you materially breach these Terms, fail to pay owed fees after notice, or if required by law.
- On termination, we will retain your data for a reasonable period (see our Privacy Policy for backup retention) to allow export, after which it may be deleted.
10. Intellectual Property
The Service, including its software, design, and branding, is owned by us or our licensors. These Terms do not grant you any rights to our intellectual property beyond the right to use the Service as intended. You retain all rights to your own business data and content.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes (e.g. by email or an in-app notice). Continued use of the Service after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles.
